Terms of Use

Loyal Plumbing, LLC is a South Dakota limited liability company. On this page, "Loyal," "we," "us," and "our" mean that company. "You" and "your" mean anyone who visits or uses this website.

You need to be 18 or older to use this website or to send us any personal information through it. We do not knowingly gather personal information from anyone younger. If we find out that we have, we will delete it promptly. Parents or guardians who believe a child has submitted information to us should contact us at info@LoyalPlumbing.com.

Home service businesses change what they offer, how they schedule, and which platforms they use, and this page has to keep up. We can revise these Terms whenever we need to, and a revision takes effect once it is posted here. When a change is significant, we will say so at the top of this page or on our homepage for a reasonable period.

Watch the "Last Updated" date. If a revision is not acceptable to you, stop using the site. Continuing to use it after a revision is posted means you are working under the revised version.

Everything published here — service descriptions, blog articles, maintenance tips, offers, photographs — exists to help you understand what we do and decide whether to call us. It is general information written for a general audience.

It is not advice about your house. Nothing here has been written with your specific equipment, plumbing, venting, gas piping, or electrical situation in mind. We have not seen your home. Do not treat anything on this site as instructions for work you should attempt yourself. Plumbing, gas, and heating and cooling repairs carry real risk of injury, fire, carbon monoxide exposure, water damage, and code violations. Please call a licensed professional.

It is not a way to reach us in an emergency. Web forms sit in a queue. If you smell gas, think you have a gas leak, or face any immediate danger to people or property, get out of the building, then call 911 and your utility company. Do not wait on a form submission.

We may take the site down. We can suspend, limit, or shut off any part of this site, or anyone's access to it, at any time and without warning.

The material on this site is ours or is licensed to us. That includes the writing, page copy, blog articles, photographs, illustrations, video, audio, graphics, page designs, layouts, software, and the way all of it is selected and arranged. We refer to all of it below as our "Content." Copyright, trademark, trade dress, and related laws protect it in the United States and abroad.

You are welcome to read our pages, print them, and save them for your own personal use as a homeowner deciding who to hire. That is what they are for. What you may not do is take our Content and use it somewhere else. If you break these Terms, we can cut off your access.

The Loyal name, our script wordmark, the yellow and black color scheme, our vehicle wrap design, our taglines, and our mascot character in every form it appears are marks and trade dress belonging to Loyal Plumbing, LLC, registered or not.

Using any of them requires our written permission first. In particular, no one may use them in a way that could lead a customer to think another business is Loyal, is connected to Loyal, is endorsed by Loyal, or is authorized by Loyal. Visiting this site gives you no license to use our marks or anyone else's.

By using the site you agree to the following.

Stay within the law. Your use of this site and its Content has to comply with applicable federal, South Dakota, and local law.

Leave our Content where it is. Do not republish it on another website, another company's marketing, a social account, or an internal network without written permission from us. Do not strip out copyright or trademark notices. Do not adapt, translate, rebrand, resell, license, or build derivative material from it. Do not use it to build or promote a business that competes with ours.

Do not feed our Content to AI systems. Our writing, photographs, and illustrations may not be copied into, ingested by, or used to train any artificial intelligence system — language models, generative tools, algorithmic products, training corpora, or anything comparable — for any purpose.

Do not harvest this site automatically. Bots, crawlers, spiders, scripts, headless browsers, extraction utilities, AI browsing agents, autonomous agents, and any other automated method of copying, indexing, monitoring, mining, or retrieving our Content are prohibited, whether or not a person is directing them. The one exception is ordinary search engine indexing: public search engines may crawl publicly available pages so long as they respect our robots.txt file and use what they collect to send people to us, not to train models or to repackage our Content elsewhere.

Be accurate with us. Information you enter into any form here should be true. Do not misstate who you are, do not claim a connection to Loyal that does not exist, and do not use this site to commit fraud.

Respect other people's privacy. Do not submit another person's private information or photograph without their permission, or a minor's without a parent or guardian's permission.

Do not use this site against us or our customers. That covers deliberate harm to our business, interference with anyone else's use of the site, impersonating another visitor or person, and harassing, threatening, or abusing our employees, technicians, or customers through any feature of the site.

Leave the site working. Do not attempt anything meant to break the site, deface it, change how it behaves, or make it harder for other people to use.

Do not attack our systems. No unauthorized access attempts, no viruses or ransomware or other malicious code, no interference with our servers or networks, no denial-of-service attacks, and no defeating any technical measure that limits access to the site or its Content.

We take other people's intellectual property seriously and we follow the Digital Millennium Copyright Act.

If material on this site infringes a copyright you own, send our agent a written notice at the address below and we will act on it. We do not judge whether a claim would ultimately win — we respond by taking the material down or blocking access to it, and we make reasonable efforts to tell whoever posted it, who is entitled under the statute to send a counter-notice. Notices and counter-notices are legal documents, and we may share them with the other party or produce them in response to legal process. Be aware that submitting a knowingly false notice or counter-notice can expose you to damages, costs, and attorney's fees. If you are unsure whether something infringes, talk to a lawyer before filing.

We link out to manufacturers, financing companies, review platforms, and other useful places. Those are other companies' websites. We have not vetted them, we do not run them, and we are not answerable for what is on them, what they sell, or how they handle your information. A link from us is a convenience, not a recommendation. Once you click through, you are on your own terms with that company.

A request submitted here is a request, not a booked appointment. When you send a form, you are asking us for a time. The appointment exists once we confirm it with you directly. We may accept a request, decline it, move it, or reschedule it. Any arrival window, response time, or completion estimate you see on this site or hear from us in advance is an estimate made in good faith, not a commitment.

This page does not govern the work we perform at your home. Scope, price, diagnostic and trip charges, payment terms, membership plan terms, financing, and every warranty — ours and the manufacturer's — are set out in the estimate, work authorization, membership agreement, or invoice we give you at or before the time of service. Those documents control. If anything on this website appears to conflict with them, the signed document wins. Nothing published on this site creates a warranty, extends a warranty, or changes the terms of one.

Prices and promotions published here can change and are not offers to form a contract. Each offer carries its own conditions — expiration date, qualifying service, minimum purchase, exclusions, whether it can be combined with anything else — and those conditions are stated with the offer and control it. Please mention an offer when you book; we cannot always apply one after the work is finished.

We correct pricing, offer, and availability errors on this site when we find them, including after someone has seen or requested the offer.

Where we mention financing, the money comes from an independent lender, not from Loyal. The lender decides approval, rate, term, and payment. Loyal does not extend credit, cannot promise approval, and is not a party to your loan. Read the lender's paperwork.

We serve Rapid City and the surrounding Black Hills, including Spearfish, Sturgis, Deadwood, Lead, Hill City, Custer, Hot Springs, Box Elder, Piedmont, Summerset, Black Hawk, Keystone, and Whitewood, across Pennington and Meade counties. Not every service is offered in every community, and coverage can change. Anyone may read this site, but scheduling is limited to the areas we actually serve. Call us if you are not sure whether your address qualifies.

Loyal is a South Dakota company serving South Dakota homeowners. We make no claim that this site is suitable or available for use anywhere else, and using it must not violate the law wherever you happen to be. If you visit from outside the United States, that is your decision and your responsibility.

Texting. If you opt in to text messages from Loyal, these Terms and our Privacy Policy apply to that program. Agreeing to marketing texts, or to autodialed or prerecorded calls, is never a condition of buying anything from us. How often we text varies with what is happening on your job. Your carrier's message and data rates apply.

To stop promotional texts, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message from us, and we will honor it within ten business days. Reply HELP for assistance, or reach us at (605) 315-3683 or info@LoyalPlumbing.com. Stopping marketing texts does not stop the operational ones about a job already on the schedule — appointment confirmations, technician-on-the-way notices, and the like.

Email. Expect email about an appointment you have booked regardless of your marketing preferences. Marketing email always carries an unsubscribe link.

Automated and AI-assisted call answering. Calls to Loyal may be picked up or assisted by an automated or AI-powered system. Ask for a person at any point and you will get one.

Recording. We may record or monitor calls for quality, training, dispatch accuracy, and recordkeeping. Tell us at the start of a call if you would rather not be recorded, or write to us instead at info@LoyalPlumbing.com.

Loyal maintains profiles on Facebook, Instagram, LinkedIn, YouTube, Google Business Profile, and Yelp, and links to them from this site.

Those platforms let anyone post, tag, comment, and review. What appears on them is not necessarily our view and is not something we can control. On the profiles where we do have control, we may remove content and block users at our discretion. When we follow, like, share, or repost someone, that is not an endorsement of them or of anything they sell.

Google and Yelp control their own review platforms and their own policies. We do not edit, remove, or filter customer reviews there, and we do not ask them to.

Send us a review, a testimonial, a photo of finished work, or a comment — whether directly or through a platform at our invitation — and you are giving Loyal permission to use it in our marketing. That permission is non-exclusive, worldwide, ongoing, and free, and it covers using your first name, last initial, and city alongside what you wrote.

In return, you are telling us that the review is your own honest opinion, that it is accurate, that it is yours to give, and that it does not expose anyone else's private information. We do not pay for positive reviews and we do not offer anything in exchange for one. We may decline to publish, or later remove, anything unlawful, abusive, deceptive, or off-topic.

If you send us a suggestion, an idea, or feedback about our business or this site, we appreciate it — and we are going to treat it as ours to use. Do not send us anything confidential, and do not send us anything belonging to someone else. We may already be working on the same idea. We can use, share, adapt, license, or act on what you send without owing you anything, and you give us all rights in it.

Now and then we may run a giveaway, contest, or similar promotion on this site or on our social profiles. Each one comes with its own rules and eligibility requirements, published with the promotion, and those rules govern that promotion.

None of this limits any liability that cannot be limited under applicable law. And to be clear about the boundary: this section is about the website. If our work at your home causes damage, that is a different matter entirely, governed by the documents described in Section 10 and by law — not by this page.

Except where the law does not allow it, you agree to defend and cover Loyal Plumbing, LLC and its owners, employees, and agents against any claim, liability, judgment, loss, cost, or expense — reasonable attorney's fees included — that arises out of your breaking these Terms, your use of this site, or your use of our Content.

22.1 What This Section Reaches

It covers any dispute, claim, or controversy between you and Loyal arising out of or relating to these Terms, this website, our Content, our text message or email programs, or your dealings with us — in contract, in tort, or on any other theory. Two things sit outside it:

22.2 Individually, Not As a Class

EACH OF US MAY PURSUE A DISPUTE ONLY ON OUR OWN BEHALF. NEITHER OF US MAY ACT AS A CLASS REPRESENTATIVE OR CLASS MEMBER, PARTICIPATE IN A COLLECTIVE OR CONSOLIDATED PROCEEDING, OR JOIN A MASS ARBITRATION. AGREEING TO THIS MEANS GIVING UP THE RIGHT TO FILE A LAWSUIT, THE RIGHT TO A JURY, AND THE RIGHT TO CLASS TREATMENT. AN ARBITRATOR HEARS THE CASE INSTEAD; THERE IS NO JUDGE AND NO JURY, AND DISCOVERY AND APPEAL RIGHTS ARE NARROWER THAN IN COURT.

22.3 Come to Us Before You File

Most problems get solved with a phone call, so this step is required before either of us starts arbitration.

Whoever has the complaint sends the other a written notice describing what happened, what they want, and how to reach them. Yours goes to info@LoyalPlumbing.com or to 814 East Omaha Street, Rapid City, SD 57701. Ours goes to the last email and mailing address we have for you. Within 30 days of that notice we will talk — by phone or video is fine — and both of us will negotiate personally and in good faith. Neither of us starts arbitration during this window, except for a claim seeking an injunction. If 60 days pass from the notice without resolution, either of us may proceed to arbitration. Any deadline for bringing a claim pauses during those 60 days. Completing this step is a precondition to arbitration.

22.4 Arbitration

A dispute that survives Section 22.3 goes to final, binding, individual arbitration before one arbitrator, administered by the American Arbitration Association under its Consumer Arbitration Rules. The AAA publishes those rules at adr.org. Arbitration is seated in Rapid City, South Dakota, unless we agree otherwise or the arbitrator decides otherwise. Costs are allocated per the AAA's consumer rules.

22.5 Who Decides What

The arbitrator decides the dispute itself and the issues that go with it. A court, not the arbitrator, decides: whether this Section 22 is valid and enforceable, whether the class waiver or jury waiver is valid and enforceable, whether a particular dispute is arbitrable at all, and whether a party was authorized to file an arbitration demand.

22.6 The Award

The arbitrator's decision is final and binding, sets no precedent, and may be entered as a judgment in any court with jurisdiction. The arbitrator cannot award damages these Terms exclude. No arbitration may be combined with another proceeding or run as a class, collective, or mass arbitration.

22.7 Opting Out — You Have 45 Days

You can keep your right to sue. Within 45 days of first using this site, send us written notice headed "Request to Opt Out of Arbitration Agreement," with your name and address, to info@LoyalPlumbing.com or to Loyal Plumbing, LLC, 814 East Omaha Street, Rapid City, SD 57701. Opting out costs you nothing, changes nothing else in these Terms, and will not affect how we treat you as a customer.

22.8 Federal Arbitration Act

This arrangement involves interstate commerce, and the Federal Arbitration Act, 9 U.S.C. §§ 1–16, governs how it is interpreted and enforced.

22.9 If Part of This Fails

IF A COURT FINDS ANY PART OF THIS SECTION 22 — INCLUDING THE CLASS WAIVER — INVALID OR UNENFORCEABLE, THEN NEITHER OF US MAY ARBITRATE, AND EVERY DISPUTE GOES TO COURT UNDER SECTION 23.

22.10 This Section Outlives the Rest

Section 22 survives the end of these Terms.

South Dakota law governs these Terms, without applying its conflict-of-laws rules. When a dispute belongs in court — because Section 22 does not reach it, because a court found Section 22 unenforceable, or because you opted out — it goes to the state or federal courts sitting in Pennington County, South Dakota, and you agree those courts have personal jurisdiction over you.

Notice to you may be sent to the email address you gave us or posted on this site. Email notice takes effect when we send it; a posted notice takes effect when it goes up. Keep your email address current with us.

Notice to us goes to info@LoyalPlumbing.com or to 814 East Omaha Street, Rapid City, SD 57701, and takes effect when it reaches us.

You agree to receive communications from us electronically, and you agree that an electronic communication satisfies any legal requirement that something be delivered in writing.

We want this site to work for everyone, including people using screen readers, keyboard navigation, magnification, or other assistive technology. We are working toward the Web Content Accessibility Guidelines (WCAG) 2.1 at Level AA. That work is ongoing rather than finished.

If any part of this site is difficult for you to use, or if you have a suggestion, call us at (605) 315-3683 or email info@LoyalPlumbing.com with "Web Accessibility" in the subject line. We will make reasonable efforts to fix the problem and, in the meantime, to help you directly by phone.

Not enforcing something is not giving it up. If we let something slide once, we have not waived that provision or any other.

One bad clause does not sink the rest. If a court finds a provision unenforceable, it gets trimmed to the smallest extent necessary and everything else stands.

Transfers. We may transfer our rights and obligations under these Terms, without notice to you, including in a sale of the business. You may not transfer yours without our written consent.

What lasts. Provisions that are meant to outlast these Terms — indemnification, the liability limits, and dispute resolution — keep working after they end.

The whole agreement about this website. These Terms and our Privacy Policy are the complete agreement between you and Loyal about your use of this site, replacing anything said before on that subject. They do not replace or modify an estimate, work authorization, membership agreement, or invoice covering work at your property. Those stand on their own.
